For them to stay in business this long they have to be doing something right... or else it is an experiment to see how badly a company can treat their customers and still not be forced to close. Or maybe they do enough local business that their mail order business doesn't really matter to them.

I am betting amazon would not tolerate the threat of being sued by these guys. I would guess that they would do their homework and then deal with them accordingly.

I'm pretty sure they stay in business by being so bad that many people can't believe they're that bad and go ahead and order from them. And then there are those who order before finding out about them.
Of course, there will be those who think this is typical of the nursery business.
I would love a copy of the old Dave's Garden Watchdog postings on TyTy. Those were very entertaining reading and really should be preserved!

There are always new people to scam, so a business like ty-ty can practically go on forever, as long as there are people that want to order plants by mail-order.
I really need to think about a clever business model, too.

Even so, the complaints against TyTy were so over-the-top that they raise serious questions about why the business hasn't been shutdown. One would think that a business that has had more complaints filed against it that all the other nurseries in the state combined, would get shut down.
Actually, what would get them shut down is if some powerful member of government took up gardening and ordered plants from TyTy. They'd be shut down real quick then.
I really need to think about a clever business model, too.
I understand Green in this holiday season. They are even making a big deal out of Green Christmas Trees.

Or perhaps something with LEDs? I like LEDs! LEDs are the coming thing in home lighting and grow lights!

BTW, despite what the article says, having the lights last longer is a distinction THIS consumer made. I got sick and tired of every year trying to find the burnt out bulb in the Xmas light string, only to have another burn out once the first one was replaced and the lights hung. (I went to fluorescent lights in the house because I was tired of climbing up on a chair to replace one burnt out bulb only to have another burn out a week later in the same fixture.)

TyTy is almost apocryphal, except they're for real.

Meanwhile, on Dave's Garden, another threat of legal action in the making....

Yikes. Those are some peeved customers. But at least the owner made an attempt to make an honest explanation on-site, while we have yet to see anything even approaching "civil" come from Ty-Ty.
Ty-Ty -- proving that using bizarre PhotoShopped photos in your marketing materials causes people to flock to your business and shell out bucks! Even after reading negative comments from past customers! I guess for every customer they lose, there's another lured by those pictures of roses the size of football helmets (with a little help from desktop photo editing).

My favorite quote from Foxd's link about the other nursery..
"...... But let's look at his positive aspects: at least he does not get rich by selling heroin." Always a bright side.

I can't stand a scam artist and this Ty Ty would be hilarious if it was not real but unfortunately it is and as for the people getting ripped off, I hope they fight back so Ty Ty will keep getting exactly the reputation he deserves.
One thing that irritates me more than Ty Ty is that I often see time again and again one or two people on EBay selling misnamed bamboo and it is obvious to me that it is not what is being advertised and I wish something could be done about it. They are often are so bold that they simply change the name of the bamboo now and then yet keep the same photo.
They must be making money because they keep doing it year after year .
Bamboo is the perfect scam on EBay for these low lives cause by the time the boo grows up it is to late to make a negative comment and the scam artist can always say "who knew that it would grow up to be a cheap multiplex instead of an expensive Java Black, the guy that sold me the seeds said it was Java Black", (very convenient).

Mike, I know exactly what you mean by the bamboo scams on ebay- I was looking for a Thamnocalamus tessalatus, and saw someone selling T. tess. "root clumps"... after emailing, to see if it sounded like they knew what they were talking about, I ordered, and got a bundle of 6" to 8" pieces of rhizome.....
after an extensive figth with them, and getting my $ back via paypal, they have changed the name... no longer selling the "clumping bamboo, thamnocalamus tessalatus", but they are selling "living fencing".

Thanks to your perseverance , at least a few goods things came out of your hassle....
You got your money back, and do you know you did a great service for your fellow EBayers? You saved them from having to go through what you had to go through because thanks to you the seller changed the name to living fence, (and who knows what that is), so buyers can now at least bid accordingly.

I still get emails from folks wondering about their green B. Lako from eBay. I'll bet most of those sold on eBay came from the same bag of seed as my D. species 69, D. Giganteus (I have a couple that are definitely not the giganteus), D. Calostachyus, D. Hamiltonii.
